These terms govern your use of the Taimba website at taimba.co.ke and the
supply of fresh produce by Taimba Ltd (“Taimba”, “we”, “us”), a company
incorporated in Kenya with offices at G.F. Corvin Complex, Off Outering Road, Nairobi. By
placing an order or creating an account you accept these terms.
1. Who we sell to
Taimba operates a business-to-business platform. Our products are sold in trade units to
businesses and institutions — green grocers, retailers, restaurants, hotels, schools,
hospitals, processors and similar buyers — for resale or use in their business. By ordering
you confirm that you are ordering for a business and that you are authorised to bind that
business.
2. Your account
- You must give accurate business details, a working phone number and a valid delivery address.
- You are responsible for everything done through your account, and for keeping your login details secure.
- Tell us immediately if you believe someone else has used your account.
- We may suspend or close an account that is used fraudulently, that repeatedly fails to accept confirmed deliveries, or that has overdue amounts owing.
3. Orders and acceptance
An order placed on the website is an offer to buy. A contract is formed only when we accept
the order — by confirming it by SMS, email or phone. Where a listed price or product detail is
materially wrong, or the produce is not available at the grade ordered, we may decline the
order and will tell you why.
The daily cut-off for next-morning delivery is 4:00pm. Orders may be changed
or cancelled free of charge before the cut-off. After that the produce has been allocated and
picked, and cancellation may be charged at cost.
4. Prices, units and taxes
- Prices are quoted in Kenya Shillings (KES) per trade unit as described on each product.
- Fresh produce prices move with the season. Prices shown online are indicative and are confirmed at acceptance; if a price has moved materially we contact you before dispatch.
- Where value added tax or any other tax applies, it is shown at checkout or on your invoice.
- Delivery within our published delivery zones is included in the price.
5. Payment
- Accepted methods are M-Pesa (at checkout or on delivery), cash on delivery where agreed, and invoice terms for approved account customers.
- Invoiced amounts fall due on the terms stated on the invoice. Overdue amounts may attract interest at 1.5% per month and may result in supply being suspended.
- Taimba will never ask you to pay a personal phone number or a till that is not in the name of Taimba Ltd.
- Title in the produce passes to you on full payment; risk passes on delivery.
6. Delivery
- We deliver to the address on your account, normally between 5:00am and 10:00am.
- A person authorised to inspect and accept the produce must be present. If nobody is available, we may leave the order with a person at the premises who appears authorised, or return it — in which case a re-delivery charge may apply.
- Delivery times are estimates. We are not liable for delays caused by weather, traffic, road closures, civil disruption or other events beyond our reasonable control.
7. Quality, inspection and remedies
Fresh produce is perishable and must be inspected at delivery. Reject any unit that is not of
the grade ordered before the driver leaves; it will be removed from your bill. If a defect is
found after delivery, notify us within two hours, quoting your order number
and, where possible, with photographs.
Where a claim is accepted, our remedy is, at our option, replacement on the next delivery run
or a credit to your account. Because the goods are perishable we cannot accept returns of
correctly supplied produce after it has been stored, repacked or displayed. Nothing in this
clause limits rights you have under Kenyan law that cannot be excluded.
8. Suppliers and farm groups
Farmers and farm groups supplying Taimba do so under separate supply arrangements agreed with
a Taimba field officer, covering grade standards, quantities, collection and payment terms.
Registering interest through this website does not by itself create a supply contract.
Registration is free: Taimba does not charge farmers any fee to register, to be listed as a
supplier, or to have produce collected.
9. Use of the website
- You may not use the site to place fraudulent orders, to scrape or copy our content or price lists for a competing service, or to attempt to interfere with the site’s security.
- All content on this site — text, photographs, illustrations, the Taimba name and logo — belongs to Taimba Ltd or its licensors and may not be reproduced without permission.
- We may change, suspend or withdraw any part of the site or the product range at any time.
10. Liability
We do not exclude liability for death or personal injury caused by our negligence, for fraud,
or for anything else that cannot lawfully be excluded. Subject to that, our total liability in
connection with an order is limited to the amount you paid for that order, and we are not
liable for loss of profit, loss of business, or indirect or consequential loss.
11. Data protection
We handle personal data in line with the Data Protection Act, 2019 and our
privacy policy.
12. Changes to these terms
We may update these terms from time to time. The version published on this page at the time
you place an order is the version that applies to that order. Material changes will be
notified to account customers by email or SMS.
13. Governing law
These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive
jurisdiction. We will always try to resolve a dispute by discussion first — call
